Property Tribunal grants dispensation application on 13 Atkins Square

Peabody’s application brought against the leaseholders of 13 Atkins Square has been granted by the Tribunal.

Peabody brought a Tribunal claim against the leaseholders of 13 Atkins Square to allow them to install a new fire alarm system without consultation. They then installed the new system without waiting for the Tribunal’s decision. Whilst the case was ongoing, they dragged it out unnecessarily by repeatedly failing to deal with the Tribunal’s instructions on how the case had to be prepared, and failed to provide to leaseholders information that the Tribunal had required them to provide.

In line with the instructions provided by residents, the Residents’ Association did not take a position either for or against the application.

The Tribunal has now specifically ordered Peabody to provide to the leaseholders within 28 days (i.e. by 5 January 2021) details of the cost of the new fire alarm system, together with an estimate of the service charges payable by the leaseholders.
